Terms and Conditions for booking of vehicle of Rowwet Mobility Private Limited ("RMPL")
- "Customer" means a prospective customer interested in online booking of RMPL Models through the official Website ("www.rowwet.in") of RMPL and includes any Individual/ Firm/ Proprietorship/ Company or other legal entity;
- In the event that the Customer is booking on behalf of another person, the necessary details of such other person is also required to be mentioned and the requisite details of such other person are required to be produced at the authorized RMPL dealer as per requirement by the Authorized RMPL Dealer. The Customer needs to provide accurate and complete information while filling the form online.
- In the event that the Customer wants to make a booking of more than one vehicle, the booking process is required to be repeated. In other words, one vehicle can be booked per booking or alternatively in case of bulk booking contact RMPL authorized dealer/distributor of RMPL;
- The online booking facility is for the convenience of the customers;
- The details of the Customer as provided by the Customer shall be used by RMPL and it's Authorized Dealers for all correspondences with the Customer;
- Booking is allowed only with the authorized Dealers of RMPL as mentioned on RMPL Website.
- The Customer is requested to thoroughly read and understand updated specifications, features of RMPL products/models posted on the Website before making their choice. The choice of variants of the RMPL models would be updated on the Website from time to time and shall be subject to availability at the selected authorized RMPL Dealers;
- The price of the vehicle shall be as applicable on the date of invoicing of the vehicle. The prices are subject to change and RMPL shall not be responsible / legally bound to inform you in advance;
- All formalities with respect to purchase of RMPL products/models, including but not limited to the registration process shall be performed at the respective authorized RMPL Dealer;
- The sale and delivery of RMPL products/models shall be subject to fulfillment of all applicable statutory obligations and submission of requisite supporting documents. The originals of these documents shall be required to be produced at the authorized RMPL Dealer. In the event of failure to ensure compliance of these requirements, the booking amount paid by the Customer shall be liable to be forfeited;
- RMPL shall not be responsible for the collection of booking amount or entire payment for RMPL products/models. The Collection of payment and the delivery of RMPL products/models shall be the responsibility of the authorized RMPL Dealer;
- All parties shall ensure the compliance of the applicable provisions of the Information Technology Act, 2000 and its allied rules as amended from time to time and prevailing and applicable in India;
- The Terms of Use and the Privacy Policy provided on Website shall be deemed to be a part and parcel of these terms and conditions;
- Please read the terms and conditions carefully before using or registering on the website or accessing any material, information or availing services through the Website and is assumed that you have read all terms and conditions before going ahead with online booking and legally binding document between Customer and RMPL.
- Acceptance of online booking payment is taken on behalf of the authorized RMPL Dealer by a payment gateway;
- The online booking engine is available at Website ("www.rowwet.in") whereas payment gateway is powered by the Intermediary providing payment gateway and merchant services;
- Payments made by the Customer for online booking of RMPL vehicles through payment gateway are subject to the terms and conditions as provided by the payment gateway intermediary/ merchant service provider. RMPL or its authorized Dealer(s) shall not be responsible for any non-payment or wrong payment made in respect of the booking through the payment gateway;
- The booking amount for RMPL vehicles will be displayed on Website. Customer cannot pay more or less than the mentioned amount for online booking of RMPL vehicles;
- The booking amount can be paid online using Debit Card/ Credit Card/ Internet Banking.
- After online submission of the form and the valid online payment transaction, the system will generate a Payment Confirmation Reference Number ("PCRN") and receipt of payment towards the booking amount. The Customer shall use PCRN and receipt to communicate with the authorized RMPL Dealer.
- The booking shall be binding only after the receipt of the full balance price of RMPL vehicle(s) and submission of requisite supporting documents. Until then, the online booking is merely a request on part of the Customer and an indication of an intention to sell on the part of the authorized RMPL Dealer and does not result in a booking confirmation or contract of sale and does not impose financial implications on RMPL or the authorized RMPL Dealer except as provided herein in these terms and conditions.
- RMPL retains the right to revise the specification, standard fitment and/or accessories of/for RMPL vehicle(s) or introduce new variants or their versions or discontinue earlier variants or versions.
Cancellation / Modification / Refund
- Cancelation request, if any, should be placed by the Customer online in case of online bookings. Please note that there shall be no offline cancellations at the authorized RMPL Dealer for online bookings.
- There shall be no booking cancellation charges if the customer cancels the booking within fourteen (14) days from the date online booking.
- The online booking amount shall be refunded to the Customer within twenty five to thirty (25-30) working days through the same mode and to the same account has been used for making the payment for booking. No cash payments shall be made by the authorized RMPL Dealer to the Customer(s).
- The refund, once processed from RMPL Dealer [acquirer/acquiring bank] end, is credited to the pool account of the issuer bank. The actual credit posted to the cardholder's account is subject to an internal reconciliation process by the issuer bank. If the funds have not been credited to the cardholder's account, Customer may be advised to approach the issuing bank customer care or escalate appropriately within the issuing bank for resolution.
- If any other amount is paid offline by the customer to the authorized RMPL Dealer towards the price of the RMPL vehicle, accessories or statutory requirement, then the customer has to claim the said amount offline from the authorized RMPL Dealer and no online transaction shall be made in this regard;
- No changes and/or modification are allowed online for RMPL vehicles after the booking has been made.
- For any change/modification, the existing booking is supposed to be cancelled and the fresh booking is required to be made.
- RMPL collects personally identifiable information when Customer registers for a RMPL account and choose the services and promotions. RMPL may also receive personally identifiable information from our business partners. When Customer register/book online with RMPL, RMPL ask for name, e-mail address, birth date, gender, occupation, industry and personal interest and signing in to our services, Customer is not anonymous to RMPL and accessing/signing Website shall be construed as consent by Customer to RMPL to use the aforesaid information as contemplated herein this terms and conditions.
- RMPL will share the information about Customer to provide the product or service Customer(s) has/have requested and RMPL respond to summons, court orders or legal process. When RMPL find Customer action on the Website violates the RMPL terms and condition or any of the terms and conditions /usage guidelines for specific products or services.
- RMPL account information is password-protected for your privacy and security wherein RMPL has taken adequate measures to secure the data.
- Email Disclaimer : This electronic transmission contains information from RMPL which is confidential and proprietary, and is intended for use only by the person named herein. In case, Customer is not intended recipient, please don't use this information in any manner, whatsoever, and immediately return it to Sender. Any views or opinions presented in this email are solely those of the author and may not necessarily reflect the opinion of RMPL.
- Customer warrant that Customer is/are competent to contract as per Indian Contract Act, 1872 or such prevailing laws in accordance with all terms and conditions of booking, sale and delivery of vehicle(s) manufactured by RMPL.
- Copyright in the pages and in the screens displaying the pages, in the information and material therein and in their arrangement, is owned by RMPL unless otherwise indicated.
- The information and materials contained in these pages, and the terms, conditions, and descriptions that appear, are subject to change. Unauthorized use of RMPL's Website and systems including but not limited to unauthorized entry into RMPL's systems, misuse of passwords, or misuse of any information posted on a site is strictly prohibited. Customer eligibility for particular products and services is subject to final determination by RMPL and/or its affiliates.
- The Website contains links to web sites controlled or offered by third parties (non-affiliates of RMPL). RMPL hereby disclaims liability for, any information, materials, and products or services posted or offered at any of the third party sites linked to this Website. By creating a link to a third party web site, RMPL does not endorse or recommend any products or services offered or information contained at that web site, nor is RMPL liable for any failure of products or services offered or advertised at those sites.
